Do I need to hire an attorney to get divorced? 

While there is no legal requirement that you have an attorney to get divorced, you should not go at it alone. Amicable resolutions are hard to come by, especially when children or large amounts of assets are involved. You need someone to advocate for you and your children’s best interests and make sure that your futures are not defined by a partner from your past — not to mention, if your partner lawyers up and you don’t, you’ll get taken to the cleaners. 

Do I need to show fault to get divorced in Texas? 

Texas is a no-fault state, which means that it is not required that either party prove fault to get a divorce. However, you must show that there is marital discord to the degree that there can be no reasonable expectation for reconciliation. This doesn’t mean that fault isn’t an important factor in divorce cases, as these factors are taken into account during property division and custody battles. 

What factors does a court consider when determining custody?
